1.1. By placing an order online or making an in-store purchase, you are making an offer to purchase a new machine from "Freshwater Small Engines."

 

1.2. Payment for the machine in full is required to confirm your order. We accept payment through the methods provided on our website.

 

1.3. Payment plans may be available for certain items, allowing you to secure your order with a deposit of 20%. For details, please contact our customer service team to organize an offline purchase.

 

2. Order Confirmation:

2.1. Upon receiving your order and confirming payment in full or the applicable deposit, we will send you an email confirming the details of your purchase. For in-store purchases, you will receive a printed receipt. These documents constitute acceptance of your order and the formation of a contract between you and "Freshwater Small Engines."

 

3. Product Acquisition:

3.1. You have the option to acquire the product through:

 

In-store pick-up: You may collect the product from our designated store location during the specified pick-up hours.

Local delivery: We offer delivery in the Cairns CBD and surrounding suburbs, including Cairns Northern Beaches, at a flat rate of $30 AUD.

4. Machine Pickup or Local Delivery:

4.1. If you choose the pick-up in-store option, you must collect your machine from our designated store location during the specified pick-up hours.

 

4.2. If you choose the local delivery option, please ensure you provide accurate delivery details during the checkout process. Delivery will be made to the address provided.

 

5. Warranty Registration:

5.1. Upon acquisition of the product, "Freshwater Small Engines" will automatically register the product for warranty on your behalf. This ensures that you are covered by the manufacturer's warranty as specified for the product.

 

5.2. Warranty details and coverage period vary by machine and manufacturer. Please refer to the warranty information provided with the machine for specific details.

 

6. Returns and Refunds:

6.1. We accept returns of new machines within 7 days from the date of purchase, provided the machine is in its original condition and packaging.

 

6.2. Refunds will be issued in Australian dollars (AUD) to the original payment method used for the purchase, minus any applicable administration fees.

 

7. Limitation of Liability:

7.1. "Freshwater Small Engines" shall not be liable for any indirect, incidental, special, or consequential damages arising from the purchase or use of the machine.

 

7.2. Our liability is limited to the purchase price of the machine.

 

8. Governing Law:

8.1. These Terms & Conditions are governed by and construed in accordance with the laws of Australia.

 

8.2. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

 

9. Changes to Terms & Conditions:

9.1. "Freshwater Small Engines" reserves the right to modify or update these Terms & Conditions at any time without prior notice. Changes will be effective upon posting on our website.
